AFTERMARKET AUTO PARTS ALLIANCE, INC.
The practices set forth in this Privacy Policy of Aftermarket Auto Parts Alliance, Inc. (“we”, “us”, or “our”) apply to the services available under the domain and subdomains of www.myplace4parts.com, www.alliance1.com, and www.allianceconnect.com (collectively, the “Site”), including the Alliance eCommerce Solutions auto parts transaction service which provides for the exchange of information pertaining to potential business transactions between potential buyers and sellers (together, “Trading Partners”), the Alliance eCommerce Solutions Electronic Parts Catalog, and other vehicle related databases provided by us (collectively, the “Product”). This Privacy Policy describes the information, as part of the normal operation of our services; we collect from you and what may happen to that information. Although this policy may seem long, we have prepared a detailed policy because we believe you should know as much as possible about our practices so that you can make informed decisions.
By accepting the Privacy Policy in registration, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of our End User License Agreement and other terms and conditions relative to the Site. This Privacy Policy is effective for all users.
The information we learn from customers helps us personalize and continually improve your experience with the Product. Here are the types of information we gather:
Information You Give Us: We receive and store any information you enter with respect to the Product or give us in any other way, including via a distributor (“Distributor”) or a website (”Distributor Site”). You can choose not to provide certain information, but then you might not be able to take advantage of many of the Product’s features. We use the information that you provide for such purposes as responding to your requests, customizing future shopping for you, improving our Product, and communicating with you.
Automatic Information: We receive and store certain types of information whenever you interact with us, including via a Distributor or Distributor Site. For example, like many web sites, we use “cookies,” and we obtain certain types of information when your web browser accesses and navigates the Site. You can set your web browser to alert you whenever you are about to receive a “cookie” and then you can choose not to accept it. If you do so, however, you may not be able to use the Product.
Information from Other Sources: We might receive information about you from other sources and add it to our account information.
(a)Internet Protocol (IP) Address. We record your IP address each time you visit the Site. Recording IP addresses helps us determine usage and traffic patterns.
(a)Feedback Form. Should you contact us through our feedback form, we require your name and e mail address only to send you a reply. If you use the form to send comments about your experience at the Site and/or with the Product, we may include the comment with your name in a Customer Testimonials section or in other collateral materials.
By transmitting any suggestions, information, identification, material, or other content (collectively, “content”) to the Site, you automatically grant us the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, redistribute, transmit, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form,, media, or technology now known or later developed for the full term of any rights that ay exist in such content. Further, we are free to use any ideas, concepts, know-how, techniques, and suggestions contained in any communications you send to this Site for any purpose whatsoever, including but not limited to creating, manufacturing, and marketing products and/or services using such information, all without compensation to you.
You understand and agree that in order for the Site to function and properly serve you, certain proprietary information will be collected by us relating to the identity, quantity, prices and dollar value of products ordered or purchased by you using the Product, or the identity of your customers, (“End User Data”) and made available to third parties, such as those who provide additional connections with the Site through which customers may order your products. Except as necessary to facilitate customers placing orders to you through such additional connections, we will not disclose the End User Data to others and will use reasonable efforts, consistent with those we use in protecting our own confidential, proprietary information, to protect against improper disclosure of any End User Data. Notwithstanding the foregoing, we and other third parties may use to End User Data internally. We and such other third parties may also perform analyses of the End User Data, only together with comparable information relating to the purchasing activity of other participants in the Product or other similar products, and may provide to others the results of such analyses, or may make available to others aggregated data concerning the purchasing activities of all or a subset of the participants in the Product or other similar products that include the End User Data; provided that such analyses or aggregated data do not contain identifying information that would enable the recipient to determine your identity or the identity of any of your customers.
Except as stated above, we do not and will not disclose your identity in any statistical reports or analyses distributed to third parties. Subject to the foregoing, you agree that we and the third parties we license or otherwise grant access to the End User Data are permitted to generate, publish, distribute, make use of, disseminate, and sell statistical information with regard to the Trading Partners, transactions, activities and other information derived from the Product (including, without limitation, registration and Product participation activities) and provide reports of aggregated anonymous data.
We release account and other personal information when we believe such release is appropriate to comply with the law or enforce or apply our End User License Agreement and other terms and
conditions or protect the rights, property, or safety of the Site, the Product, our users, or others. This includes exchange information with other companies and organizations for fraud protections and credit risk reduction. Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in the Privacy Policy. Obviously, however, this does not include selling, renting, sharing, or other wise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in the Privacy Policy.
Our Site includes links to other websites. If you decide to follow these links, we are not responsible for the privacy policies and content of these sites.
The Site’s database tracks the traffic throughout our site. This information is used to compile overall statistics and is not recorded at an individual level. The statistics help us decide which products and services best serve our members and guests.
Although no use of the Internet is 100% secure, we work to protect the security of your information during transmission. We are currently using Secure Sockets Layer (SSL) software as a security tool, which encrypts information you input. We may use other tools in addition to our in lieu of SSL from time to time.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off or close your browser window when finished using a shared computer. You are responsible for all actions taken with your credential and password, including fees charged to your account. Therefore, you should not disclose your Site user name and password to any third parties. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.
The Site give you access to a broad range of information about your account and your interactions with the Alliance eCommerce Solutions program for a limited purpose of viewing and, in certain cases, updating that information. You cannot access the information of other users of the Site.
As discussed above, you can always choose not to provide information, even though it might be needed to make a purchase or to take advantage of certain features of the Site or the Product.
If you choose to visit the Site, your visit and any dispute over privacy is subject to this Privacy Policy and our End User License Agreement and other terms and conditions, including limitations on damages, and
application of the law of the State of Texas. If you have any concern about privacy or terms of use of the Site, please contact us with a thorough description, and we will try to resolve it. Our business changes, and our Privacy Policy and the End User License Agreement will change also. You should check the Site frequently to see recent changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
We may amend this Privacy Policy at any tome by posting the amended terms on the Site. All amended terms shall automatically be effective when they are initially posted on the site.
